1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "Client", "Studio", or "You") and QuickGames ("Company", "we", "our", or "us"), regarding your access to and use of the QuickGames website and playable ad creation platform (the "Services").

By accessing the website, registering an account, or deploying playable ads generated by our platform, you agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are prohibited from using the Services and must discontinue use immediately.

2. Eligibility & Accounts

To use our Services, you must satisfy the following conditions:

You must be at least 18 years of age, or the legal age of majority in your jurisdiction.
You must provide accurate, current, and complete information during registration.
You are responsible for safeguarding your password and account credentials. You accept full responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these guidelines or exhibit suspicious behavior.

3. Platform License

Subject to your compliance with these Terms, QuickGames grants you a non-exclusive, non-transferable, revocable, limited license to access and use our AI-powered creation tools, download generated playable packages, and integrate our telemetry SDK solely for your internal business operations and mobile app promotion campaigns.

4. Intellectual Property Rights

Our website, platform, code, templates, graphics, user interface designs, and AI engines are the sole property of QuickGames and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly provided in these Terms, no part of our Services, templates, or assets may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without our prior written consent.

5. User Uploaded Assets

When you upload characters, logos, audio tracks, and other creative assets ("User Content") to our platform for conversion into playable ads, you retain all ownership rights in your User Content.

However, by uploading User Content, you grant QuickGames a worldwide, royalty-free, non-exclusive license to host, copy, transmit, format, and display your assets solely for the purpose of generating, serving, testing, and displaying your playable ads through the platform and connected networks.

Representation: You represent and warrant that you own or have the necessary licenses and permissions to use and authorize us to use all uploaded assets, and that they do not infringe upon any third-party copyrights or trademarks.

6. Prohibited Activities

As a condition of your use of the Services, you agree not to:

Decompile, reverse engineer, or disassemble any portion of our software or SDK.
Use any automated scraping, data mining, robots, or similar data extraction methods to download templates or metrics.
Upload malicious code, viruses, malware, or assets containing offensive, illegal, or discriminatory material.
Attempt to bypass security constraints or access control mechanisms.
Use the generated playable ads in a manner that violates ad network policies (e.g., deceptive click triggers or false advertising).

7. Billing & Subscription Terms

Certain features and volume thresholds of the QuickGames platform require a paid subscription plan.

Fees: All fees are stated in US Dollars (USD) or Indian Rupees (INR) depending on your region and are non-refundable unless specified otherwise.
Automatic Renewals: Monthly and annual subscriptions renew automatically until cancelled via the billing panel.
Taxes: Users are responsible for all applicable taxes associated with their purchase.

8. Limitation of Liability & Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKGAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTIBILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL QUICKGAMES, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR GENERATED CREATIVES.

9. Governing Law & Jurisdiction

These Terms shall be governed by and defined following the laws of India. You and QuickGames irrevocably consent that the courts of Bangalore, Karnataka, India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
